Terms of Service

These Terms of Service ("Terms") govern your use of the Abeam mobile application, website, and related services (collectively, the "Service"), operated by Jorge Ruiz, doing business as Abeam ("Abeam," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@flyabeam.com if you suspect unauthorized access.

You agree to provide accurate, current, and complete information when creating your account and to keep that information updated.

3. Subscription Services

3.1 Subscription Plans

Abeam offers free and paid subscription tiers. Features available under each tier are described in the app and on our website.

3.2 Billing and Auto-Renewal

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected at signup). Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

If you purchase a subscription through the Apple App Store, billing is handled by Apple, and subscription management (including cancellation) is performed through your Apple ID account settings.

If you purchase a subscription through our website via Stripe, billing is handled by Stripe, and you can manage your subscription through the account settings in the app.

3.3 Free Trial

We may offer a free trial period (currently 7 days) for new subscribers. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the then-current price. You can cancel at any time during the trial without charge.

3.4 Cancellation

You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will continue to have access to paid features until then.

3.5 Refunds

• App Store purchases: refunds are handled exclusively by Apple, subject to Apple's refund policies. We cannot process refunds for App Store transactions.
• Direct purchases (Stripe): generally non-refundable except as required by applicable law. Contact support@flyabeam.com for refund requests.

3.6 Price Changes

We may change subscription prices from time to time. We will provide reasonable advance notice of any price changes, and the new price will apply to your next renewal after the notice period.

4. User Content

4.1 Your Content

You may upload study materials (PDFs, images) to the Service to generate personalized practice questions. You retain ownership of the content you upload ("Your Content").

By uploading content, you grant us a limited, non-exclusive license to process, store, and analyze Your Content solely to provide the Service to you (including generating study questions via AI processing).

4.2 Your Responsibilities

You represent and warrant that:

• You own or have the right to upload Your Content
• Your Content does not infringe any third party's intellectual property, privacy, or other rights
• Your Content does not contain malicious code, illegal material, or content prohibited by Section 5

4.3 Our Content

All content provided by the Service (including questions, scenarios, explanations, audio, illustrations, and software) is owned by us or our licensors and protected by intellectual property laws. You may use this content solely for your personal, non-commercial study purposes within the Service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Scrape, harvest, or collect data from the Service through automated means
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to any part of the Service
• Upload content that is illegal, infringing, harassing, defamatory, or otherwise objectionable
• Share your account credentials with others
• Use the Service to develop a competing product
• Resell, sublicense, or commercially exploit the Service or its content

6. Aviation Safety Disclaimer — Important

Abeam is a study aid designed to supplement formal flight training. It is NOT a substitute for, and does not replace:

• Training by a certified flight instructor (CFI)
• FAA-approved training materials and curricula
• Current FAA publications (FAR/AIM, ACs, AC 00-6, AC 00-45, etc.)
• Required ground school or check ride preparation
• The judgment of a pilot in command (PIC) during actual flight operations

Aviation regulations, procedures, and aeronautical information change frequently. While we strive for accuracy and currency, we cannot guarantee that all content in the Service reflects the most recent regulatory state. You are responsible for verifying all information against authoritative FAA sources before applying it in flight planning, training, or actual flight operations.

Some content within the Service is generated by artificial intelligence. AI-generated content may contain errors, including incorrect regulatory citations or outdated procedures. Always verify against primary sources.

The Service is not approved or endorsed by the Federal Aviation Administration (FAA) or any other regulatory body. Successful completion of practice quizzes within the Service does not constitute FAA certification, qualification, or currency.

You acknowledge that aviation activities carry inherent risk, and that pilot proficiency is the responsibility of the pilot, not the Service. Abeam disclaims all liability for actions taken or not taken based on content provided by the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components. Your use of the Service is at your sole risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT WILL ABEAM, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE
• OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50)

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

9. Indemnification

You agree to indemnify and hold harmless Abeam, its affiliates, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, Your Content, or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

You may terminate your account at any time by following the account deletion process in the app or by contacting support@flyabeam.com.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and dispute resolution provisions).

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. For material changes, we will provide additional notice via the app or email. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. The federal and state courts located in Texas will have exclusive jurisdiction over any disputes arising out of or related to these Terms, except as otherwise required by applicable consumer protection laws in your jurisdiction.

13. Apple-Specific Terms

If you accessed the Service through the Apple App Store, you acknowledge and agree:

• These Terms are between you and Jorge Ruiz, doing business as Abeam — not with Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide maintenance or support for the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
• Apple is not responsible for addressing any claims by you or any third party related to the Service.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
